Gun Rights Upheld!

In a historic decision, the Supreme Court has ruled 5-4 that the District of Columbia’s strict handgun ban, in place since 1976, is unconstitutional.

This was the High Court’s first foray into the legality of the US Constitution’s Second Amendment which reads: “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.”

The issue in the DC case, and at the heart of the entire gun debate, was whether individuals indeed have the right to keep arms under the 2nd Amendment without being part of a “militia”.

Pro-gun forces long have pointed to the fact that the first act of all tyrannies is to disarm their publics and thus that individual gun ownership is essential to freedom.

Writing for the conservative majority, Justice Antonin Scalia wrote that the Constitution does not allow “the absolute prohibition of handguns held and used for self-defense in the home.”

And this is key to the legitimacy of the ruling, the words “self defense”. Because under what is called Natural Law — that idealistic and God-given criteria to which free peoples, including Americans, adhere to rule themselves justly — the right of self defense is sacrosanct.

And to this any sensible person would agree.

Except to America’s gun-banning liberals.

For decades now, Democrats have been chipping away at citizens’ rights to defend themselves including through gun ownership, while at the same time defending criminals who use guns, or any other weapons, to commit crimes.

In contrast, the National Rifle Association long has been pressing government to be absolute in prosecution of people using guns to commit crimes because those people are betraying the essential nature of legitimate gun ownership. But Democrats have dragged their feet and even dropped anchor. Because to the Democrat party, criminals are not the problem. They contend that gun ownership is the culprit in the explosion of violent crime. And for once, the Democrats are partially right. The only word they leave out is “criminal” gun ownership. Because even criminals can “own” guns.

Under Natural Law, the right to self-defense means the right to fend off an attacker. But in America today, if a burglar breaks into your home and threatens you with an illegally-obtained gun, you will be prosecuted if you kill that burglar with your own legal gun.

Fewer and fewer Americans, however, legally own guns because of roadblocks to ownership installed by Democrats, like the DC ban.

The result is that over many decades we have lost the experience of a society in which legitimate gun ownership has been allowed to counterbalance, and fight back against, criminal gun use. Therefore, we see rising crime.

In a society where we would be freer to own guns and with more laws allowing us to defend ourselves and our property, you would see a drop in crime because criminals no longer would have the law — and defenseless citizens — on their side.

The Supreme Court decision will reverberate for years to come, as gun bans are challenged all over America. And when we have a law-abiding population that is no longer afraid of the armed criminal element, a safer, freer, more just and more humane society will result.
