Judge Sonia Sotomayor Is An Activist Judge

Appeals Court Judge Sonia Sotomayor admits she is an activist judge where she can “make law.” She is considered a leading contender to replace David Souter on the Supreme Court and spoke at a panel at Duke University Law School in 2005. She is responding to a question on the pros and cons of different types of judicial clerkships.

    All judges are “activist” judges. By interpreting the law, they define the law. All she is saying here is that the Courts of Appeal rule on whether lower courts acts within the bounds of the law, and by doing so, they instruct the lower courts on proper legal behavior.

    No matter what decision an Appellate court makes, to overturn, to uphold or to refuse to hear, it sends a message to the judges on what the Appeals court expects.

      See, that’s the problem, Axel…judges are not meant to “make” the law. They are meant to “interpret” existing law, according to the constitution and legal precedent.
