By interpreting the law, they define the law. All she is saying here is that the Courts of Appeal rule on whether lower courts acts within the bounds of the law, and by doing so, they instruct the lower courts on proper legal behavior. No matter what decision an Appellate court makes, to overturn, to uphold or to refuse to hear, it sends a message to the judges on what the Appeals court expects. All judges are “activist” judges. By interpreting the law, they define the law.
